CKE sporadic load on post edit with minify on

been testing 5 hrs today, recompiled php/apache multiple times to rule a lot of stuff out.

turn minify off, editor loads fine.
turn it on, fails 70% or so of the time.
all skins,all browsers, multtiple areas of the country (US), stock skin with all hooks disabled too.
fastcgi, suphp, suexec, does not matter.
no cdn or anything esoteric used during testing, stock paths/urls and stock skin was used.

I can pretty much duplicate this at will, turn minify on and editing posts starts failing immediately.

I am starting to really dislike this CKE.
